Acts of God

Bijoulie.com shall not be held liable for non-performance, in whole or in part, of any of its obligations whatsoever toward you, nor for damages or losses you may suffer, if such non-performance, damages or losses result from an Act of God or from circumstances beyond its control.



SALES CONDITIONS

Are there inherent conditions in accepting an order?

The reception of a confirmation email for an order does not automatically mean that bijoulie.com accepts the said order and is in no way a confirmation that bijoulie.com warrants the sale of the items.

bijoulie.com does retain the right, without prior notice, to refuse to deal with a customer and/or impose a limit on the requested quantity of an ordered item. At all times, it might be necessary for bijoulie.com to complete a background check on your identity and credit prior to accept to fulfill an order.

Legal guarantees

The Civic Code of Quebec and the Consumer Protection Law provides legal guarantees namely related to hidden defects as well as usage of sold goods. These legal guarantees also apply to this sale.

Out of stock items

An item that is back order means that the product is currently unavailable. It is possible that the order is being processed with one of our suppliers, out of stock, recalled, or discontinued, if so, you shall be advised.

bijoulie.com displays all the items that can be ordered from either one of our suppliers. It must be noted though that these items may not be in stock in one of our stores or the website. In the case where bijoulie.com must wait for one of the out-of-stock items becomes available, it is possible that your order be held back prior to expedition.

bijoulie.com does in no way guarantee that the items displayed on its site are available. At anytime prior to the site's reception of the item, you can cancel the order by calling our Customer Service Department. It must be noted that out-of-stock that have been ordered from our supplier and have not been delivered by said within ninety (90) days will automatically cancel your order without prior notice.

bijoulie.com will in no way be held liable for any damage that you may experience due to the out-of-stock item.

Product descriptions

bijoulie.com and its affiliates do everything in their power to ensure that the information on the site is as accurate as possible. However, bijoulie.com does not guarantee that the product descriptions or any other content on the site bijoulie.com are accurate, complete, reliable, up to date, or exempt of errors. If a product proposed by bijoulie.com does not comply with the description, your only recourse is to return it in its original state.

Prices

The prices of our products are displayed in Canadian currency and the applicable taxes are added to the amount. All orders, regardless of their origin, are payable in Canadian currency. bijoulie.com retains the right to modify its prices at any time. Products are always billed on the basis of the amounts in effect at the time when the order is recorded.

Taxes

bijoulie.com calculates the taxes based upon the address where the order will be shipped. An order to be sent to the U.S.A. is thus, not taxed. For an order shipped in Canada, the taxes depend upon the province; for example, for Quebec, the added taxes are QST (Quebec Sales Tax) and the GST (Goods & Services Taxes).

Payment

The payment of your purchased items must be completed through a banking card: MasterCard or Visa, or PAYPAL payment services. The proposed fees must be covered in accordance with the payment procedure detailed during the registration process. The customer accepts to cover the total cost as well as additional fees of the purchased item, including taxes. bijoulie.com can modify the price after having advised the customer. The customer is the sole responsible of the actual payment of the purchased item. bijoulie.com is not responsible of payment problems related to operation of e-commerce service.

Risk of a lost item

All purchases completed on bijoulie.com are done so in accordance with the shipping contract. This means that the risk of losing an item and property rights associated with the item are transferred to you at the moment when we remit the item to the carrier.

Please anticipate an additional wait time if your products are out of stock or if they are missing. In the event that we must wait for an item to arrive, it is possible the item will be held for a few days before it is expedited.

How to take advantage of our free shipping

In order to benefit from our free shipping, your order must be of 100$ or more, excluding taxes and delivery charges.

Shipping outside of Canada

Yes you can, but for all products that are delivered outside of Canada, you are responsible for all custom fees as well as export fess.

Returns

You have up to ten (10) days from its reception to return a product to bijoulie.com; for either a refund or an exchange. When you return an item, you must include the invoice and a note that details the reason behind the return.

If you still have the original packaging, you simply go to your local post office and mark the package Return to Sender.

Returning an item for a reason other than a defect

You must cover the shipping fees and the inherent risks for a returned item. For items that are not defective, we do not accept returns wherein the item has been removed from the package or, in the case of a book, when it shows evidence a wear and tear.

Returning a defective product

In the case where an item is defective, it will be exchange for a new copy of the same item. If bijoulie.com has delivered the wrong item, bijoulie.com will ship the correct one. In both cases, bijoulie.com will cover the fees associated with the delivery and the risks as long as the return is completed Canada Post's standard services.

Reimbursement

Upon reception of the returned items, the amounts that were debited from your credit card and/or on your bijoulie.com prepaid card for bijoulie.com with respect to these items, except for shipping fees, will be credited as soon as possible under the condition that the items that are subject to the return were done so by you and received by bijoulie.com in the same condition as they were when they were shipped and received by you.
